I would suggest you ask your employer B to file thru premium processing. Just to be on the safe side
cancellation takes atleast a month if not more. (4-5 months is not a confirmed number so its better to assume the worse case of 1 month)

As far as I know, I think you need an approved I-140 before you can use AC21.

our ead is expiring in sep1st week. My attorney has just filed for ead renewal, am still waiting for a receipt no.
Since am working in H1 and not used EAD yet, i wont have any problem.
My wife is currently working on H1B and had plan to switch on EAD, although she has not started using the current EAD.
And her H1 is also expiring in september.
I am now afraid what will happen if her EAD doesnot get renewed before the expiry date. She may neither be able to work in H1 nor EAD.
i should have applied for ead renewal myself instead of waiting for employer to file. The process is getting delayed now.
Guys, is there any way to expedite her EAD to be approved soon?
can she continue work in h1 even if her h1 has expired until 90 days?

This electronic process will allow Employers and/or their Designated Representatives to submit and obtain prevailing wage determinations (PWD) for use in the H-1B, H-1B1 (Chile/Singapore), H-1C, H-2B, E-3 (Australia), and permanent labor certification programs through the iCERT portal.

Can you elaborate the process for infopass?
I tried and got mine but when I tried to get an appt for my wife I got a message saying I cannot schedule an appointment.
if not allowing using EAD receipt, book appointment with I-485 receipt. At counter yo can ask EAD question.

It is not OK for the attorney to sign the papers. But no body is going to care as long as there is signature in that column. Just keep quiet, u will be fine. Ask your attorney for a copy of your filed 485 so that if anything happens, you can sign similarly in all the correspondence.

Leave aside ranking, this MBA program is not accredited by AACSB (AACSB International-The Association to Advance Collegiate Schools of Business (http://www.aacsb.edu)), the institution which accredits Business Schools. I wonder what value you will get in the market for an MBA from this University.

During my LCA my company moved 10 miles to another city which was in a different county and my attorney had to file for a new LC. In fact she also asked to mention any other location (like house if in different city) if that was applicable.
The main reason for that is salary level.
Your statement is true only for the H1B visa, I guess the person who started this thread is asking about the opinion of starting GC process from the state where company is located, the answer to that query it is fine, because it is for future employment

This plea is for people who are still undecided about the rally and have lot of friends in the same situation. If there is a group of friends in the same situation it only takes one brave soul to make a decision and every one will jump in. We all seen this in trivial matters like going for vacation, movies etc..
I see the problem is in taking the first step and others will jump right in immediately. So if your friends look up for you to make the decision, please be a leader and do it now. You will not only make a difference in their life and their life as well.

Absolutely, she can go for stamping in India with your H1B approval and get it stamped. If she were in US, based on your H1B approval she will get an Dependent approval notice and a new I-94, she still needs H4 visa to travel.
If you file for H1B renewal in regular process it might take more time, so if you are in a hurry then go for Premium.

"Is it usual for big employers to already have H1 visas to sponser you on".. All I know is that employers cannot have blank visas for hiring whom they want. They have to file a new application for a specific employee, so they have to start from scratch.
If your F1 covers you for 2.5 years, then there's some hope that immigration laws will change during this time. Because right now it's a nightmare. If nothing changes in the laws and cap number stays at ~65,000, then you will have to win a lottery to get an H1. We'll see on April 1, but most likely there is also a lottery for Master's degree holders.

My attorney signed my I-485 AOS/EAD/AP applications and posted them on July 2nd as he was in a hurry to apply because of July 2nd scenario. Is it ok for the attorney to sign our papers. Is anybody in the same boat as me. I am a little concerned as the USCIS FAQ says application can be rejected if signature is missing. The application reached USCIS on July 3rd.
My attorney also did the same. I did not sign on my application. But he sent me power of attorney to sign. They did this since they were beating the July 2 brouhaha which previous to that week, they already knew what's going to happen.

Hi,
I recently received EAD and my I-140 approved an year ago . I am waiting for the 180 days count down to be over. but my question here is after 180 days if i want to use AC21 , do we really need to have the I-140 apporval copy or receipt number bcz it is still with my employer and they are not going to share with the me for sure. But it got approved and year ago for me.
Also is there any way i can get the receipt number of I140 by calling the USCIS ?

I have a similar timeline - applied for LC in February 2002, got approval in December 2003, filed I-140 in February 2004, I-485 in March 2004. Currently filing for my fifth EAD! The USCIS not only tortures the whole family (it's a common practice that name check is pending only for primary applicant) but makes us to pay for the wait! My son was born around the time we filed for adjustment of status, he will go to school soon but we are still not sure whether we will be allowed to stay. We cannot plan ahead and open education funds for our children. My wife cannot go to college, as she is not eligible for in-state tuition discount. Needless to say, I am forced to sacrifice my career as the whole thing is dragging for 5+ years and I have to work at the same position to keep GC process alive. I've got MCSD certificate and outgrew my position long ago. I cannot quit my job and found a new business.
